ADA Website Accessibility Lawsuit: a clothing and accessories retailer

Plaintiff PEDRO VERGARA, represented by Roderick V. Hannah, Esq., P.A. and Law Office of Pelayo Duran, P.A., filed a lawsuit in the United States District Court, Southern District of Florida, on July 12, 2022, alleging violations of Title III of the Americans with Disabilities Act against an online clothing and accessories retailer. Additionally, inside the shopping bag, items' color, size, style number, low stock, subtotal, shipping, and estimated total lack labels, and the wish list button is mislabeled as "remove button."

This legal action highlights the critical importance of digital accessibility for e-commerce platforms, particularly for visually impaired users who rely on screen reader software. Businesses operating online retail websites must ensure their digital interfaces are fully navigable and communicative to avoid discrimination claims under the ADA Title III.
