ADA Website Accessibility Lawsuit: an online apparel retailer

Plaintiff NELSON FERNANDEZ has filed a federal lawsuit in the United States District Court, Southern District of Florida, on July 15, 2022, against an online apparel retailer. The plaintiff, represented by RODERICK V. HANNAH, ESQ., P.A., alleges that the defendant's website is not accessible to visually impaired users, violating Title III of the Americans with Disabilities Act (ADA) and the Palm Beach Code.

The complaint specifically outlines several accessibility barriers on the e-commerce website, including a slideshow carousel that is not properly labeled, site information (address, hours) not integrated with screen readers, a mislabeled home page button/company logo, product descriptions and prices not labeled for screen readers, and out-of-stock notices mislabeled as "disable" without further description. Furthermore, notifications for items added to the shopping cart are unlabeled, and text throughout the website is not labeled, causing the screen reader to skip information. The website also lacks an effectively accessible "accessibility" statement or widget/plugin for prompt assistance.

This lawsuit highlights significant legal risks for businesses, especially online apparel retailers, that operate websites not fully conforming to ADA and WCAG standards. Companies must ensure their digital platforms are accessible to all users, including those with visual disabilities who rely on screen reader software.
