ADA Website Accessibility Lawsuit: An Online Fashion Retailer

Plaintiff Aishia Petersen has filed an ADA Title III lawsuit against an online fashion retailer in the Southern District of Florida on September 16, 2022. The complaint alleges that the e-commerce website is not fully or equally accessible to blind and visually impaired consumers, thereby violating the Americans with Disabilities Act.

The complaint details several critical accessibility barriers, including mislabeled product images that use image links or numbers instead of descriptive text, a complete lack of 'alt' attributes for images, and instances of duplicate IDs or labels being used for multiple products. Further issues include a failure to announce store addresses and a lack of proper keyboard navigation for store locations, an "Add to Bag" feature that does not inform users when an item has been added, and a non-functional "skip to Content" feature. These deficiencies collectively prevent screen-reading software from effectively conveying website content to visually impaired users.

This legal action underscores the ongoing imperative for businesses, particularly those operating e-commerce platforms, to ensure their digital presence is fully accessible to individuals with disabilities.
