ADA Website Accessibility Lawsuit: Fashion Brand

Aishia Petersen, a legally blind individual, has filed a lawsuit in the United States District Court, Southern District of Florida, on September 22, 2022, against an online fashion shoe retailer. Represented by Acacia Barros, P.A., the plaintiff alleges that the retailer's e-commerce website is not fully or equally accessible to blind and visually impaired consumers, thereby violating Title III of the Americans with Disabilities Act (ADA).

The complaint details multiple specific WCAG violations that impede screen-reader software functionality. These include product images lacking descriptive alt text or having duplicate IDs, sub-menu elements being inaccessible via keyboard navigation, and critical features like size, price, and 'Add to Bag' buttons on product pages lacking keyboard focus. Furthermore, pop-up dialog boxes exhibit poor focus management, and the "skip to content" feature does not function correctly, rendering the website mouse-dependent and incompatible with assistive technologies.

This legal action highlights the ongoing risk for online fashion shoe retailers and similar businesses that fail to design, build, and maintain their websites to be fully accessible.
