ADA Website Accessibility Lawsuit: An online kitchen and bathroom furnishings retailer

Plaintiff NELSON FERNANDEZ has filed a federal lawsuit in the United States District Court, Southern District of Florida, on November 2, 2022, against an online retailer of kitchen and bathroom furnishings, fixtures, and accessories. The plaintiff, who is visually impaired and physically disabled, alleges that the defendant's e-commerce website is inaccessible to individuals using screen reader software, violating Title III of the Americans with Disabilities Act (ADA) and the Rehabilitation Act.

The complaint specifically details several access barriers on the e-commerce website, including a mislabeled home page button, an improperly labeled telephone number, “Filter By” headers that do not integrate with screen readers, inaccessible prices, and text that is not properly labeled, causing screen readers to skip content. These issues collectively prevent blind and visually disabled users from effectively navigating and utilizing the website, which also serves as a critical point of sale and an extension of the defendant's physical showrooms. The complaint further asserts that the website fails to meet Web Content Accessibility Guidelines (WCAG) 2.0 Level AA standards.
