ADA Website Accessibility Lawsuit: an online ice cream shop

Plaintiff James Watson has filed an ADA Title III lawsuit against an ice cream shop operating an online presence in the United States District Court for the Southern District of Florida, Miami Division, on February 28, 2023. The complaint seeks injunctive relief, attorney's fees, litigation expenses, and costs due to alleged inaccessibility of the shop's mobile website to visually impaired users.

The lawsuit specifically alleges multiple WCAG 2.1 Level A and AA Guideline violations. These include a main menu graphic button on the mobile ordering page lacking a proper label (announced only as "label"), the main menu graphic button on the homepage failing to receive focus or be announced, a meaningful sequence violation preventing completion of an online order due to an unannounced delivery popup, and a focus order violation hindering online pickup orders because of an unannounced location popup. Additionally, the complaint cites a quantity field that is unlabeled (announced as "one"), incorrectly labeled tip buttons on the cart screen, and unlabeled 'Remove' buttons next to products, all of which impede effective use by screen reader software.

This case highlights the ongoing legal risks for businesses, particularly those with physical locations that extend services online, to ensure their digital platforms comply with ADA Title III and WCAG guidelines. Failure to provide equal access to mobile websites can lead to legal action, requiring significant modifications to web properties, and incurring substantial legal costs for non-compliant entities.
