ADA Website Accessibility Lawsuit: An Online Apparel and Accessories Retailer

Nelson Fernandez, represented by Roderick V. Hannah, Esq., P.A., has filed a lawsuit in the United States District Court Southern District of Florida on November 7, 2023, against an online apparel and accessories retailer. The complaint alleges that the retailer's e-commerce website is not fully accessible to visually impaired and physically disabled users, in violation of Title III of the Americans with Disabilities Act (ADA).

The lawsuit details several accessibility barriers on the defendant's website, including product images mislabeled as "link," inaccessible pricing information when browsing products, and unavailable size and color details within the shopping cart. Furthermore, the complaint asserts that order summary information, such as subtotal and shipping costs, is inaccessible to keyboard navigation within the shopping cart, and the category list in the women's section is also mislabeled as "link." The plaintiff contends these issues prevent equal access for screen reader users and indicate a failure to meet WCAG 2.0 Level AA standards.

This action highlights the ongoing legal risks for businesses operating e-commerce websites that fail to implement robust accessibility features.
