ADA Website Accessibility Lawsuit: An International Apparel Retailer

Plaintiff VICTOR ARIZA filed a lawsuit against an international apparel retailer in the United States District Court for the Southern District of Florida on November 30, 2023. Plaintiff, who is blind and visually disabled, alleges that the defendant's e-commerce website violates Title III of the Americans with Disabilities Act due to numerous accessibility barriers, denying him full and equal access. The complaint details several specific WCAG violations on the e-commerce website, including improperly labeled text that caused the screen reader cursor to skip information and navigate to the nearest accessible element. Further barriers included a lack of confirmation when shopping cart quantities were changed and inaccessible text within pop-up confirmation messages for item removal, rendering the embedded accessibility widget ineffective.
