ADA Website Accessibility Lawsuit: an online luxury goods retailer

Plaintiff NELSON FERNANDEZ, represented by RODERICK V. HANNAH, ESQ., P.A., has filed an ADA Title III website accessibility lawsuit against an online luxury goods retailer. The complaint was filed in the United States District Court, Southern District of Florida on January 11, 2024.

The lawsuit alleges numerous WCAG violations, including a mislabeled home page button, improperly labeled icons (like the search button described as "link"), improperly labeled product images lacking full descriptions for screen readers, product descriptions and pricing not integrated with screen readers, lack of notification when an item is removed from the shopping cart, and unlabelled information in the shopping cart (price and subtotal). The complaint also highlights the absence of a useful "accessibility" notice or policy that is effectively accessible to screen reader users, and the e-commerce website's failure to meet WCAG 2.0 Level AA or higher standards.

This legal action underscores the critical importance for similar online luxury goods retailers, particularly those operating e-commerce websites linked to physical stores, to ensure their digital platforms are fully accessible to blind and visually disabled users. Non-compliance with ADA Title III and WCAG standards can lead to significant legal liabilities, including declaratory and injunctive relief, as well as demands for attorney's fees and costs, for businesses failing to provide equal access to their online goods, services, and information.
