ADA Website Accessibility Lawsuit: National Restaurant Chain

Enrique Alvear, represented by Roderick V. Hannah, ESQ., P.A., has filed a federal complaint in the United States District Court for the Southern District of Florida on February 15, 2024. The lawsuit alleges that a national restaurant chain's website contains accessibility barriers that prevent blind and visually disabled individuals from fully accessing its services, in violation of Title III of the Americans with Disabilities Act.

The complaint specifically details multiple Web Content Accessibility Guidelines (WCAG) 2.1 Level A and AA violations. These include issues with non-text content lacking clear purpose, complicated navigation due to focus moving to hidden elements, pop-ups not receiving focus or being announced, unlabeled buttons with unclear link purposes, the inability to customize menu items for nutritional information, unannounced FAQ buttons, and images of text containing unannounced content. Additionally, status messages, such as item additions to an order, were not announced to screen reader users.

This legal action highlights the ongoing risks faced by businesses, particularly those in the restaurant industry with an online presence, that fail to ensure their digital platforms are fully accessible to individuals with disabilities. It underscores the necessity of adhering to WCAG standards to provide equal access to goods, services, privileges, and advantages offered through websites, thereby avoiding potential ADA Title III litigation.
