ADA Website Accessibility Lawsuit: An Online Retailer

ARANTZA CASTRO has filed a federal lawsuit in the United States District Court, Southern District of Florida, on February 26, 2024, alleging that an online clothing and accessories retailer's website is not fully accessible to visually impaired users, violating Title III of the Americans with Disabilities Act. The plaintiff, who uses screen reader software, seeks declaratory and injunctive relief to compel the defendant to update its digital platform to comply with accessibility standards.

The complaint outlines several specific WCAG 2.2 violations, including keyboard traps within rewards modals and review filters, inability to activate product size and sorting dropdowns via keyboard, lack of audible confirmation for adding items to a bag, blank audible labels for checkout fields like email address, incomplete audible labels for shipping options (omitting prices), and absence of audible error suggestions for incorrect credit card numbers. These barriers prevent the plaintiff from independently navigating and fully utilizing the e-commerce website.

This legal action highlights the ongoing risks for online businesses that fail to ensure their websites meet established digital accessibility guidelines, such as WCAG.
