ADA Website Accessibility Lawsuit: An Online Luxury Retailer

Plaintiff Oscar Herrera, represented by Roderick V. Hannah, Esq., P.A. and Law Office of Pelayo Duran, P.A., filed a federal lawsuit in the United States District Court, Southern District of Florida on April 8, 2024, against an online luxury retailer. The complaint alleges that the defendant's website fails to comply with Title III of the Americans with Disabilities Act, denying equal access to visually disabled individuals.

The lawsuit specifically identifies several Web Content Accessibility Guidelines (WCAG) 2.1 Level A and AA violations. These include keyboard navigation failures for menu items, missing descriptive labels for color and size links announced as alphanumeric strings, unlabeled 'X' or Close buttons, unlabeled password buttons on the "Create Account" page, and unannounced status messages for cart additions. These issues reportedly prevent screen reader users from effectively interacting with the digital platform.

This action highlights the ongoing legal risks for businesses, especially those operating e-commerce websites with physical store connections, that do not ensure their digital platforms are fully accessible to individuals with visual disabilities.
