ADA Website Accessibility Lawsuit: An Optical Retailer

Plaintiff Nelson Fernandez, represented by Roderick V. Hannah, ESQ., P.A., has filed a lawsuit against an optical retailer in the United States District Court, Southern District of Florida, on April 19, 2024. The complaint alleges unlawful disability discrimination under Title III of the Americans with Disabilities Act, primarily concerning the accessibility of the retailer's website to visually disabled individuals.

The complaint details several critical WCAG violations on the e-commerce website, including inaccessible drop-down menu options on the "Main Menu" that failed to announce their collapsed or expanded state, a mislabeled email address and telephone number lacking full descriptions, improperly labeled product descriptions, brands, and pricing information for sunglasses, and a logo functioning as a link mislabeled as "link" without further purpose description. Additionally, customization options for products like prescription type were unavailable when navigating with a keyboard.

This legal action highlights the significant risks faced by businesses operating websites that are not compliant with ADA Title III and Web Content Accessibility Guidelines (WCAG). Similar online retailers, especially those with brick-and-mortar stores, must ensure their digital platforms provide full and equal access to all users, including those with visual disabilities, to avoid potential lawsuits and ensure compliance with federal accessibility laws.
