ADA Website Accessibility Lawsuit: Private College

Milagros Senior, a visually-impaired and legally blind individual, initiated a federal complaint in the United States District Court for the Southern District of New York on February 13, 2025. Her civil rights action targets a private college, alleging systemic failures to provide a website fully accessible and independently usable by persons with visual disabilities, thereby violating Title III of the Americans with Disabilities Act and the Rehabilitation Act of 1973.

The complaint details a series of specific digital accessibility barriers encountered on the academic institution's website. These include a critical lack of alternative text for non-text elements and images, empty links devoid of descriptive text, and numerous redundant links that complicate navigation for screen reader users. Further issues encompass pages sharing identical title elements, numerous broken links, absence of text-based title frames for navigation, and inadequate equivalent text for scripts. Forms are not presented with functionality comparable to those for sighted users, content structure is not conveyed beyond visual presentation, and text resizing capabilities are impaired. Additional challenges involve user interface components lacking discernible keyboard focus indicators, web pages without clear titles or programmatically determined default languages, and instances where component focus or setting changes trigger unintended context shifts. Furthermore, the plaintiff noted a lack of labels or instructions for user input fields, issues with markup language implementation leading to incomplete tags or duplicate attributes, and the presence of inaccessible Portable Document Format (PDF) files.

Organizations operating similar online platforms face significant legal exposure if their digital properties do not adhere to established accessibility standards. The Department of Justice consistently emphasizes that the ADA extends to web content, implying a continuous obligation for public accommodations to ensure equal access to their online services for individuals with disabilities.
