ADA Website Accessibility Lawsuit: An online aloe product retailer

Plaintiff Judith Adela Fernandez Martinez, a visually-impaired and legally blind individual, has initiated a federal civil rights action against an online aloe product retailer. The lawsuit was filed in the United States District Court for the Southern District of New York on August 8, 2025. Martinez, on behalf of herself and a proposed class of others similarly situated, alleges that the digital platform fails to provide equal access to its products and services for blind and visually-impaired consumers.

The complaint details numerous specific accessibility barriers encountered by the plaintiff when attempting to navigate the site using screen-reading software. These violations include a lack of alternative text for graphical images, empty links without descriptive text, redundant links leading to the same destination, and linked images missing alt-text. Furthermore, the website featured pages with identical title elements, making it difficult for screen readers to differentiate content, and contained broken links that redirected users to error pages without proper communication from the screen reader, hindering navigation and the user's ability to return to their original search.

This action underscores the growing legal imperative for digital businesses, particularly those engaged in e-commerce, to ensure their online presence is fully inclusive for individuals with disabilities. Companies that maintain interactive websites offering goods and services, without adhering to established accessibility standards such as WCAG 2.0 Guidelines, face significant legal exposure under Title III of the Americans with Disabilities Act.
