ADA Website Accessibility Lawsuit: Building Products Manufacturer

Plaintiff Cesar Lucien, a visually-impaired and legally blind individual, has initiated a federal class action lawsuit against a prominent building products manufacturer and its various subsidiaries. Filed on August 27, 2025, in the Southern District of New York, this complaint, brought by JOSEPH & NORINSBERG, LLC, alleges that the defendant organization’s array of public-facing websites systematically deny full and equal access to disabled users, violating Title III of the Americans with Disabilities Act. Lucien's reliance on screen-reading software was hindered by persistent digital barriers across several of the manufacturer's online platforms.

Plaintiff Lucien encountered significant issues, including the absence of alternative text for images, rendering visual content inaccessible to screen readers. Insufficient color contrast further impaired readability, and inaccessible PDF documents, lacking proper screen reader tagging, along with non-functional embedded maps and dealer locators, created significant barriers. These deficiencies align with failures under WCAG Success Criteria 1.1.1 (Non-text Content), 2.4.6 (Headings and Labels), and 4.1.2 (Name, Role, Value).

This litigation highlights the persistent legal exposure faced by online businesses whose digital interfaces are not designed to be universally accessible. Companies operating public-facing websites, especially those deeply integrated into sales and customer engagement, must proactively address WCAG standards to mitigate legal challenges under ADA Title III and similar state laws.
