ADA Website Accessibility Lawsuit: Healthcare Distributor

Plaintiff Beth Kramer, represented by JOSEPH & NORINSBERG, LLC, filed a class action lawsuit on January 5, 2026, in the United States District Court for the Southern District of New York against a major healthcare and pharmaceutical distribution company. The complaint alleges that the defendant's website, an essential resource for healthcare information and services, contains pervasive accessibility barriers that deny blind and visually impaired individuals full and equal access under Title III of the Americans with Disabilities Act (ADA) and related New York state and city civil rights laws.

The lawsuit specifically details multiple Web Content Accessibility Guidelines (WCAG) 2.1 Level A and AA violations. These include missing alternative text on hundreds of images and PDFs, ARIA-hidden elements containing focusable content, absolute positioning that breaks reading order, generic link text, missing or empty headings, animated images without pause controls, broken links and server errors, ARIA reference errors, and very low contrast text. Plaintiff, who relies on screen-reading software, was unable to independently navigate the site or access critical health-related information, underscoring the severe functional impact of these barriers.

This legal action highlights the ongoing necessity for digital platforms, especially those providing essential services, to adhere to WCAG standards.
