ADA Website Accessibility Lawsuit: an online formalwear retailer

Plaintiff Beth Kramer filed a class action lawsuit on February 10, 2026, in the United States District Court, Southern District of New York, against an online formalwear retailer. The complaint alleges that the retailer's e-commerce website is inaccessible to blind and visually impaired users who rely on screen-reading software like NVDA, denying them equal access to its products and services.

The lawsuit identifies numerous Web Content Accessibility Guidelines (WCAG) violations, including missing or placeholder alternative text on product images, ARIA-hidden elements containing focusable content causing screen readers to announce silence, and buttons, links, and controls lacking accessible names. Other barriers include nested interactive elements preventing screen readers from announcing roles and states, inaccessible product carousels, CSS positioning issues causing reading order divergence, autoplaying media without pause controls, and pricing information not programmatically conveyed. A SortSite audit further confirmed systemic issues across over 1,000 pages, highlighting unlabeled links and form controls, missing headings, and promotional banners that were inaccessible.

This action underscores the significant legal risks faced by businesses operating digital platforms that fail to implement comprehensive accessibility measures. Companies with e-commerce websites must ensure their sites are fully perceivable and navigable by individuals with disabilities to avoid potential litigation under ADA Title III and similar state laws, highlighting the necessity for adherence to WCAG 2.1 Level AA standards.
