ADA Website Accessibility Lawsuit: Online Clothing Retailer

WASHINGTON BENAVIDES MORAN has filed a federal lawsuit against an online clothing retailer in the U.S. District Court for the Southern District of New York on February 13, 2026. The plaintiff alleges that the defendant's interactive website is not fully accessible to blind and visually-impaired individuals, in violation of the Americans with Disabilities Act (ADA), the New York State Human Rights Law, the New York City Human Rights Law, and the New York State General Business Law.

The complaint outlines several accessibility barriers on the defendant's platform, including a lack of alternative text for images and linked images, empty links without descriptive text, and redundant links. Users also encountered pages with identical title elements, broken links, and a keyboard-operable user interface lacking a discernible focus indicator. Additionally, issues were noted with forms not providing the same functionality as for sighted users, missing labels or instructions for user input (such as captcha prompts), and inaccessible Portable Document Format (PDFs). These conditions reportedly denied WASHINGTON BENAVIDES MORAN and other blind users equal access to products and services.

This action highlights the ongoing legal risks for online retailers and other public accommodations whose digital platforms fail to comply with the Americans with Disabilities Act. Businesses operating e-commerce websites must ensure their platforms are fully accessible to disabled users, including those relying on screen-reading software, to avoid similar litigation and potential injunctive relief and damages.
