ADA Website Accessibility Lawsuit: an online home theater technology retailer

Plaintiff Susan Russo, a legally blind Manhattan resident, has initiated legal proceedings against an online home theater technology retailer in the United States District Court for the Southern District of New York. The lawsuit, filed on July 1, 2026, alleges that the company's e-commerce platform fails to provide equal access to individuals with visual impairments, thereby violating multiple federal and state disability rights laws. Ms. Russo, a proficient screen-reader user, sought to independently browse and purchase specialized projectors and screens but encountered significant digital barriers.

The complaint details pervasive accessibility issues, corroborated by SortSite audits, revealing that a substantial portion of the retailer's website contained design flaws. Key WCAG 2.1 violations included missing or inadequate alternative text for product and promotional images, rendering visual characteristics inaccessible to blind users. Furthermore, unlabeled form controls and interactive buttons, along with improper and inconsistent heading structures, prevented effective keyboard navigation and distinction of functions. The site also suffered from broken ARIA references, low-contrast text on critical information, and numerous broken navigation links, all of which impeded full and equal transactional access.

This case underscores the increasing legal scrutiny faced by businesses operating e-commerce platforms that are not designed for universal accessibility. The failure to adhere to Web Content Accessibility Guidelines (WCAG 2.1) exposes companies across various sectors to potential litigation under ADA Title III and analogous state and local statutes.
