ADA Website Accessibility Lawsuit: an online tools and industrial supplies retailer

Paul Abramson, a visually-impaired individual, initiated legal proceedings against an online retailer specializing in tools and industrial supplies. This civil rights action, alleging violations of the Americans with Disabilities Act (ADA) Title III, the New York State Human Rights Law, and the New York City Human Rights Law, was filed in the United States District Court, Eastern District of New York, on October 29, 2024.

The complaint details numerous accessibility barriers preventing screen-reader users from independently navigating the defendant's website. Key issues include an incorrectly defined landmark structure with repetitive labels, headings that failed to adequately describe content sections, and improperly formatted website category lists leading to confusion. Furthermore, the platform featured ambiguous or overly long link descriptions, non-interactive elements incorrectly marked as keyboard focusable without appropriate roles, and interactive elements lacking descriptive names or the ability to be focused by the Tab key. The absence of proper alt-text for many images and unclear/ambiguous labels for form fields also significantly hindered information input and overall user experience, often requiring mouse interaction for transactions which is inaccessible to blind users.

Businesses operating digital platforms must recognize the escalating legal scrutiny surrounding website accessibility. This case underscores the imperative for online entities, particularly those serving a broad consumer base, to integrate comprehensive accessibility features, such as those outlined in WCAG guidelines.
