ADA Website Accessibility Lawsuit: Outdoor Apparel Retailer

Nataly Morales has filed a class action lawsuit in the United States District Court for the Central District of California on October 01, 2021, against an outdoor apparel retailer. The lawsuit asserts that the retailer's digital platform fails to be fully accessible to blind and visually impaired individuals, thereby violating ADA Title III and California's Unruh Civil Rights Act.

The complaint specifically highlights numerous WCAG violations, including the absence of alternative text for non-text elements and linked images, missing title frames for navigation, and non-equivalent text for scripts. Further alleged barriers involve forms lacking the same functionality for disabled users, content structure not conveyed non-visually, and text that cannot be resized. Other issues cited include unadjustable time limits, web pages without descriptive titles, unclear link purposes, and a non-discernible keyboard focus indicator, along with inaccessible Portable Document Format (PDFs).
