ADA Website Accessibility Lawsuit: a Denim Lifestyle Brand

Plaintiff Crystal Redick has filed a class action lawsuit against an online lifestyle brand in the United States District Court for the Central District of California on February 3, 2022. The complaint alleges that the e-commerce website fails to provide full and equal access to visually impaired individuals, thereby violating their rights under the Americans with Disabilities Act (ADA) Title III and California's Unruh Civil Rights Act.

The lawsuit specifically details a range of accessibility barriers encountered by Plaintiff and other visually impaired users. These include a lack of alternative text for non-text elements and linked images, missing title frames for identification and navigation, equivalent text not provided for scripts, and forms lacking functionality for sighted persons. Further issues involve content not conveying meaning beyond visual presentation, inability to resize text without functionality loss, enforced time limits, web pages without descriptive titles, unidentifiable link purposes, lack of discernible keyboard focus indicators, undetermined default human language, and elements in markup languages with incomplete tags, nesting issues, duplicate attributes, or non-unique IDs. Additionally, inaccessible Portable Document Format (PDFs), empty links, redundant links, and issues with user interface element roles and settings were cited.

This complaint highlights the ongoing legal risks faced by online retailers and service providers if their digital platforms are not designed and maintained to be fully accessible to disabled users. Businesses operating e-commerce websites and integrated physical locations must ensure compliance with accessibility standards like WCAG 2.1 to avoid similar lawsuits, potential injunctive relief, and statutory damages for discriminatory practices against individuals with disabilities.
