ADA Website Accessibility Lawsuit: an online luggage and accessories retailer

Crystal Redick, represented by WILSHIRE LAW FIRM, filed an ADA Title III lawsuit against an online luggage and accessories retailer in the United States District Court for the Central District of California on April 8, 2022. The complaint alleges that the e-commerce website is not fully and equally accessible to and independently usable by visually impaired individuals, violating the Americans with Disabilities Act and California's Unruh Civil Rights Act.

The complaint details numerous Web Content Accessibility Guidelines (WCAG) violations, including a lack of alternative text for non-text elements and linked images, missing title frames for identification and navigation, and equivalent text not being provided for scripts. Further issues include forms that lack the same information and functionality for visually impaired users, content where meaning and structure are not conveyed beyond visual presentation, and text that cannot be resized without functionality loss. The website also reportedly suffers from unclear link purposes, a lack of discernible keyboard focus indicators, non-programmatically determined default human language, and user interface elements that initiate unexpected context changes or lack proper labels for input. Additionally, the platform allegedly contains inaccessible Portable Document Format (PDFs), markup language issues, and empty or redundant links causing navigation difficulties for screen reader users.

This lawsuit highlights the significant legal exposure for businesses operating e-commerce websites that fail to adhere to established accessibility standards like WCAG 2.1. Similar online retailers are at risk of class action litigation under the ADA and state civil rights acts if their digital platforms are not independently usable by visually impaired consumers, leading to potential injunctions, statutory damages, and attorneys' fees.
