ADA Website Accessibility Lawsuit: an online gaming retailer

Plaintiff ALI ABDULHADI, represented by Oceanside Law Center APC, has filed a class action lawsuit against an online gaming retailer in the United States District Court for the Central District of California on August 30, 2023. The plaintiff, who is legally blind and uses screen-reading software, alleges that the defendant's website, an e-commerce platform for gaming products, is not fully and equally accessible to him and other visually-impaired individuals.

The complaint alleges numerous specific WCAG violations against the online platform, including the absence of text equivalents for non-text elements, lack of descriptive page titles, broken links, and the inability to determine link purpose from text alone. It further cites issues with keyboard operability due to invisible focus indicators, content that cannot be resized without losing functionality, and the failure to programmatically determine the default human language of pages. Additional allegations include problems with markup (incomplete tags, duplicate attributes), inaccessible Portable Document Formats (PDFs), and user interface elements lacking programmatically determinable names and roles, all of which hinder independent use by screen reader users.

This action highlights the significant legal risks faced by other businesses, particularly those operating in the e-commerce sector, that fail to ensure their digital platforms are fully and equally accessible to individuals with visual impairments, potentially leading to similar ADA Title III litigation and demands for injunctive relief and damages.
