ADA Website Accessibility Lawsuit: Online Beauty Salon

Nelson Fernandez, represented by Roderick V. Hannah, Esq., P.A., has filed a federal lawsuit against an online beauty salon retailer in the United States District Court for the Southern District of Florida on August 27, 2024. The complaint alleges unlawful disability discrimination under Title III of the Americans with Disabilities Act, seeking declaratory and injunctive relief, attorney's fees, costs, and litigation expenses.

The lawsuit details several Web Content Accessibility Guidelines (WCAG) violations, including mislabeled logos and social media links lacking descriptive text, mislabeled site functions such as a "menu" identified as "group," inaccessible service and pricing information where the cursor skips content, and general failures in keyboard navigation. Additionally, the plaintiff alleges the absence of an accessibility notice, statement, or policy on the e-commerce website and a lack of the universal disabled symbol.

This case highlights the significant legal risks faced by businesses operating e-commerce websites and digital platforms that fail to comply with ADA Title III and WCAG standards. Companies in the beauty salon industry and other online service providers must ensure their digital properties are fully accessible to individuals with visual disabilities to avoid potential litigation and uphold equal access.
