ADA Website Accessibility Lawsuit: a hotel and resort

Plaintiff NELSON FERNANDEZ, represented by Roderick V. Hannah, Esq., P.A. and Law Office of Pelayo Duran, P.A., filed a lawsuit in the United States District Court Southern District of Florida on October 8, 2024, alleging violations of Title III of the Americans with Disabilities Act. The complaint targets a foreign limited partnership operating a hotel and its associated e-commerce website, which serves as a critical point of booking and sale, providing information and services to the public.

The complaint details several accessibility barriers on the e-commerce website, including improperly labeled text that causes cursor skips, insufficient image descriptions, inaccessible contact information (unlabeled addresses and unclear telephone numbers), loss of functionality for main menu links during keyboard navigation, a mislabeled logo acting as a home page link, and an improperly integrated quantity adjustment function for booking rooms. These issues prevent visually disabled users from fully and equally accessing the website's content and services, failing to meet WCAG 2.0 Level AA standards.

This lawsuit highlights the critical need for online platforms, particularly those serving as extensions of public accommodations like hotels, to ensure their digital assets are fully accessible.
