ADA Website Accessibility Lawsuit: an online accessories retailer

Aishia Petersen, a legally blind individual, has filed an ADA Title III lawsuit against an online accessories retailer in the United States District Court Southern District of Florida, Miami Division, on October 24, 2024. The plaintiff alleges that the defendant's e-commerce website is not fully or equally accessible to blind and visually impaired consumers.

The complaint specifically cites several WCAG violations, including the absence of meaningful descriptions for images (resulting in HTML links with numbers/code instead of alt text), an inaccessible "Locate a Store" page where addresses are skipped during keyboard navigation and lack focus, mislabeled product images and colors on product pages, and a checkout pop-up window that is not announced by screen readers, preventing transaction completion. These barriers render the website incompatible with screen-reading software like JAWS and Voiceover.

This lawsuit highlights the ongoing legal imperative for online businesses, especially those operating e-commerce platforms, to ensure their digital properties comply with ADA Title III and WCAG guidelines. Failure to provide effective communication and equal access for individuals with disabilities can lead to significant legal challenges, including demands for permanent injunctive relief and payment of attorney's fees.
