ADA Website Accessibility Lawsuit: an online apparel retailer

YUDY HERNANDEZ, represented by Mendez Law Offices, PLLC and Adams & Associates, P.A., filed a lawsuit on November 5, 2024, in the United States District Court, Southern District of Florida, against an online apparel retailer. The plaintiff, who has severe visual impairment and uses screen reader software, alleges that the e-commerce website is inaccessible to individuals with disabilities, thereby violating Title III of the Americans with Disabilities Act. This complaint highlights the ongoing challenges faced by visually impaired users in accessing digital platforms.

The complaint details several specific WCAG 2.1 violations, including issues with Bypass Blocks (2.4.1 Level A) preventing users from skipping repetitive content, Error Identification (3.3.1 Level A) failing to notify users of missing input in forms, and Status Messages (4.1.3 Level AA) not being programmatically determined for assistive technologies. Additional violations include problems with Meaningful Sequence (1.3.2 Level A), Focus Order (2.4.3 Level A) within pop-up modals, and Link Purpose (2.4.4 Level A) being ambiguous. These barriers collectively prevent screen reader users from browsing merchandise, adding items to a cart, or completing the checkout process.

This lawsuit underscores the critical importance for online businesses, particularly e-commerce sites, to proactively ensure their digital platforms comply with WCAG 2.1 Level AA standards.
