ADA Website Accessibility Lawsuit: a luxury apparel and accessories retailer

Plaintiff OSCAR HERRERA, represented by Roderick V. Hannah, Esq., P.A. and Law Office of Pelayo Duran, P.A., has filed an ADA Title III website accessibility lawsuit against an online luxury apparel and accessories retailer. The complaint was lodged in the United States District Court for the Southern District of Florida on January 28, 2025, alleging that the e-commerce website's barriers deny blind and visually disabled individuals equal access.

The complaint specifically details several Web Content Accessibility Guidelines (WCAG) 2.1 Level A and AA violations. These include a "No Keyboard Trap" (2.1.2) issue where tab focus becomes stuck in expanded submenus, multiple "Focus Order" (2.4.3) problems with unannounced or unfocused pop-ups (promotional, 'Fit Quiz', and email entry), and confusing focus shifts in product detail sections. Furthermore, "Name, Role, Value" (4.1.2) violations are cited due to incorrectly labeled color options and a wishlist link that loses its descriptive label, alongside a "Status Messages" (4.1.3) issue for the lack of verbal notification when a product is added to a wishlist.

This legal action highlights the ongoing vulnerability of businesses, particularly those operating e-commerce websites with physical store locations, to ADA Title III litigation if their digital platforms fail to meet accessibility standards.
