ADA Website Accessibility Lawsuit: Fitness Company E-commerce Site

Plaintiff Yudy Hernandez, represented by Mendez Law Offices, PLLC and Adams & Associates, P.A., has filed an ADA Title III lawsuit in the Southern District of Florida on February 10, 2025, against a foreign profit corporation operating an online nutritional supplement and apparel store. The visually impaired plaintiff seeks declaratory and injunctive relief, as well as damages, alleging that the e-commerce website's accessibility barriers prevent her from full and equal access to its products and services.

The complaint details numerous WCAG 2.1 Level A and AA violations. These include a lack of mechanisms to bypass main navigation blocks, an inability to pause/stop/hide automatically playing content, ambiguous link purposes for critical functions like "Main Menu," "Search the Site," and "View Cart," and insufficient error identification for various input fields during login, password reset, product filtering, and guest checkout. Further allegations include failures in keyboard operability for product filters, non-preservation of meaningful sequence and focus order within an "Add to Cart Modal" popup, and content below minimum contrast ratios when modals are active.

This action highlights the ongoing legal risks for online retailers and public accommodations whose digital platforms fail to meet WCAG standards. Businesses operating e-commerce websites, particularly those offering nutritional supplements and apparel, are urged to ensure their platforms are fully accessible to disabled users, including those relying on screen reader software, to avoid similar claims of discrimination and ensure equal participation in the digital economy.
