ADA Website Accessibility Lawsuit: An Online Uniform Retailer

Plaintiff VICTOR ARIZA has filed a federal lawsuit in the United States District Court Southern District of Florida on March 27, 2025, against an online uniform and apparel retailer. Represented by the law firm RODERICK V. HANNAH, ESQ., P.A., Mr. Ariza, who is blind and uses screen reader software, alleges that the defendant's website fails to provide full and equal access to disabled individuals, violating Title III of the Americans with Disabilities Act.

The complaint specifically alleges several critical WCAG violations, including inaccessible product pricing information, improperly labeled text that causes screen readers to skip vital content, and a shopping cart confirmation message that only appears visually without an auditory equivalent, preventing screen reader users from recognizing deletion requests. Furthermore, the plaintiff asserts that the website's accessibility statement and widget/plugin were ineffective, creating additional barriers, and that the website fails to meet Web Content Accessibility Guidelines (WCAG) 2.0 Level AA or higher versions of web accessibility.

This lawsuit underscores the legal imperative for all businesses operating e-commerce websites, especially those with a nexus to physical public accommodations, to ensure their digital platforms are fully accessible to individuals with disabilities. Failure to implement fundamental accessibility features, such as proper labeling, screen reader compatibility, and clear navigation, exposes such businesses to significant litigation risk under the ADA and alienates a substantial portion of the consumer market.
