ADA Website Accessibility Lawsuit: Online Frozen Food Retailer

Plaintiff Raymond T. Mahlberg, represented by ACACIA BARROS, P.A., has filed a lawsuit in the United States District Court Southern District of Florida on April 30, 2025, alleging that an online frozen meat and seafood retailer's website is not fully accessible to blind and visually impaired consumers. The plaintiff, who is legally blind and uses screen-reading software, claims the website's digital barriers prevent him from accessing goods, services, and information, thus denying him equal access under Title III of the Americans with Disabilities Act.

The complaint outlines several specific WCAG violations, including: the inability to find store locations due to a lack of focus and screen-reader incompatibility with addresses and phone numbers; images lacking meaningful descriptions and not being readable by keyboards, with product page images announcing numbers instead of prices; difficulties in the checkout process where 'added to cart' messages are not announced and cart contents are unclear; increase/decrease quantity buttons only announcing 'button' without indicating price or having proper labels/focus; and overall poor contrast in background, text, and products, coupled with a lack of a zoom feature.

This lawsuit highlights the ongoing legal risks faced by online businesses, particularly those operating e-commerce platforms that serve as extensions or gateways to physical stores.
